By purchasing from Tom Darby Design, you agree to the following terms and conditions. Please read them carefully before placing an order.
1. About My Work
All pieces are handmade in my studio in Germany. Variations in glaze, texture, and shape are natural and part of the character of each piece – they do not constitute defects.
2. Orders
Orders are placed through the online shop at tomdarbydesign.com
Custom or made-to-order pieces require advance payment before production begins.
I reserve the right to decline or cancel orders, for example in cases of unavailability, payment issues, or suspected fraud.
3. Prices & Payment
Prices are listed in EUR, USD, GBP and include VAT where applicable.
Shipping costs are calculated at checkout based on destination, size, and weight.
Payments are accepted via Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay, Bancontact, EPS, Klarna, Shop Pay.
As a small business owner according to § 19 UStG, no sales tax is charged.
4. Shipping & Delivery
I ship worldwide from Germany using trusted carriers.
Delivery times vary by destination (see Shipping Policy).
For international orders, customs duties, taxes, and fees are the buyer’s responsibility.
All orders include tracking; high-value items are insured.
5. Returns & Exchanges
Returns are only accepted if the item arrives damaged, defective, or if the wrong item was sent.
Change-of-mind returns and custom orders are excluded from return or exchange.
In case of transport damage, please contact me within 48 hours of delivery with photos of the item and packaging.
Approved returns must be sent back in the original packaging using insured, trackable shipping.
Refunds are issued within 14 business days after receipt and inspection of the returned item.
6. Copyright
All images, designs, product descriptions, and website content are the property of Tom Darby Design and may not be copied, reproduced, or used without written permission.
7. Limitation of Liability
I am not liable for:
- Delays caused by postal services, couriers, or customs,
- Damage or loss after delivery,
- Indirect or consequential damages resulting from the purchase or use of the product.
Some pieces may have sharp or delicate edges and must be handled with care.
By purchasing from Tom Darby Design, you acknowledge that these works serve their described decorative and/or functional purpose and require appropriate handling.
I assume no responsibility for injuries, damage, or loss resulting from improper use or handling after delivery.
8. Privacy
Your personal data is used solely to process and deliver your order. I only share your information as necessary for order fulfillment. For more details, please refer to my Privacy Policy.
9. Governing Law
These terms are governed by German law and EU law. The place of jurisdiction is the courts of Germany.
